By using northbaypaintingservices.com or engaging North Bay Painting Services for residential or commercial painting work, you agree to these Terms of Service. If you do not agree, please do not use our services.
2. Who We Are
North Bay Painting Services ("we", "us", "our") is an Ontario-based painting contractor led by Ahmed Khalil. We serve North Bay and 17 surrounding communities across Nipissing District. Our business address is Suite 23028 Ferris, 276 Lakeshore Drive, North Bay, ON P1A 4K6. We have been serving the area since 2016.
3. Services
We provide interior, exterior, cabinet, commercial, industrial, institutional, and specialty painting services as described on this website. The specific scope of any project is confirmed in writing in your individual quote.
4. Quotes and Estimates
- All quotes are provided free of charge based on a site visit and project assessment
- Quotes are valid for 30 days from the issue date unless otherwise noted
- Pricing reflects the scope of work confirmed at the time of quote
- Material and labor cost changes after the quote period may require re-quoting
- Verbal estimates are not binding; only written quotes constitute a formal offer
5. Booking and Scheduling
- A signed written quote is required to book your project
- A deposit may be required to reserve your scheduled start date (amount specified in your quote)
- Scheduling depends on weather (for exterior work), crew availability, and material lead times
- We provide reasonable notice for any schedule changes
6. Scope Changes
- Changes to project scope after work begins require a written change order
- Additional work outside the original quote will be billed at our published rates
- We will not proceed with scope changes without your approval
7. Payment Terms
- Final payment is due upon project completion unless otherwise agreed in writing
- We accept cheque, e-transfer, debit, and major credit cards
- Late payments may be subject to interest charges at the rate disclosed in your quote
- Outstanding balances may delay or void warranty service
8. Warranty
- We provide a 1-year written warranty on workmanship from project completion
- The warranty covers defects in our application: peeling, blistering, or finish failure under normal conditions
- The warranty does not cover damage from acts of nature, abnormal use, structural movement, water infiltration, third-party modification, or normal wear and tear
- Warranty claims must be reported within 30 days of discovery
- Warranty work is provided at our discretion using comparable materials
9. Limitations of Liability
- Our total liability is limited to the value of services provided under the relevant quote
- We are not liable for indirect, consequential, special, or incidental damages
- Pre-existing conditions (rot, water damage, structural issues, lead paint) are documented before work begins; we are not responsible for issues stemming from these conditions
- Color matching is approximate; minor variations from samples are normal due to lighting and substrate differences
10. Customer Responsibilities
You agree to:
- Provide accurate information about your property and project goals
- Move or cover personal items in work areas before our arrival
- Provide reasonable site access during scheduled work hours
- Disclose any known hazards (asbestos, lead paint, electrical issues, biohazards)
- Not interfere with active work in ways that compromise crew safety
- Allow reasonable time for paint cure before reinstalling fixtures or moving furniture
11. Intellectual Property
- All website content, photos, and copy are the property of North Bay Painting Services
- Project photos taken during work may be used in our marketing portfolio (we will not include identifying address details without your consent)
- You may not copy or reproduce our website content without written permission
12. Third-Party Links
Our website may link to third-party resources (manufacturer specifications, building authorities, partner sites). We are not responsible for the content, privacy practices, or availability of external sites.
13. Governing Law
These terms are governed by the laws of the Province of Ontario, Canada. Any dispute arising out of or relating to these terms or our services will be resolved in the courts of Nipissing District, Ontario.
14. Severability
If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
15. Changes to These Terms
We may update these terms periodically. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the revised terms.
Frequently Asked Questions
How long is a written quote valid?
Our written quotes are valid for 30 days from the issue date unless we note otherwise on the quote itself. Pricing is locked in for that 30-day window based on the scope, materials, and labor rates we costed at the time of the site visit. If you book within those 30 days the price holds. If material or labor costs move significantly after that window we may need to re-quote, but we will tell you before doing any work.
What payment methods does North Bay Painting Services accept?
We accept cheque, e-transfer, debit, and major credit cards. Most homeowners pay by e-transfer because it is fast and free on their end. A deposit may be required to lock in your scheduled start date and the amount is shown on your written quote. Final payment is due on project completion unless we have agreed in writing to a different schedule.
What does the 1-year written warranty cover?
Our 1-year written warranty covers defects in our workmanship, including peeling, blistering, or finish failure under normal conditions. It does not cover damage from acts of nature, abnormal use, structural movement, water infiltration, third-party modifications, or normal wear and tear. Warranty claims must be reported within 30 days of you noticing the issue. We will inspect the work and, where the claim is valid, repair it using comparable materials at our cost.
Can I cancel a booked painting project after signing?
Yes. Reach out as soon as possible by phone at (705) 482-1142 or through the contact form. If you cancel before any materials have been ordered or work has begun, your deposit refund (if any) is handled per the terms on your written quote. Once materials are purchased or crew time is scheduled, costs already incurred may be deducted from the refund. We try to work things out fairly with every customer.
What happens if my project scope changes mid-job?
Scope changes happen. Maybe you decide to paint the trim after all, or we uncover hidden damage that needs to be repaired before painting can continue. In every case we stop, document the change in a written change order, and get your sign-off before doing the additional work. Extra work is billed at our published rates and your original quote stays intact for everything else.
